I have the honour to acknowledge Your Excel-

-lency's Confidential communication of the 16th. instant with

reference to the projected arrangements for borrowing the Chief

Justice (the Judge) of Shanghai to sit as a Judge of Appeal in

this Colony. I think it advisable to draw Your Excellency's

attention to the fact that as all the Original Jurisdiction

cases are taken (except in very rare cases) by the chief

Justice in this Colony, the proposed arrangement would make

the Judge of Shanghai the Judge of Appeal from the Chief

Justice of Hongkong. I venture to suggest that Your Excellency

should cable to the Secretary of State to this effect, and beg

that before the arrangements are concluded, the details should

be communicated to Your Excellency for consideration.
